Objectives-Chapter 5

5.1   List the types of liability an employer can incur as a result of the actions of his employee.  Chapter 5 deals with how criminal law can relate to business.  There is a brief discussion of the categories of crimes as well as the elements of different crimes.

5.2  Define a crime and a civil wrong and identify the differences between them.  

5.3  Identify and list the defenses to crimes, as well as the process that a criminally accused person goes through from arrest to trial to sentencing.  

5.4  Define and Identify White Collar Crime as that type of crime mostly relates to business situations.  

5.5  Review the discussion about Sentencing Guidelines and Compliance and identify how the guidelines relate to White Collar Crime.

The important case to know for Chapter 5 is:  Elonis v. United States. This case is very timely given the many threats and shootings that seem to occur in the workplace nowadays. Can someone be convicted of a crime just for making a threat?

Chapter 5 Discussion Board

Read the discussion question at the end of Chapter 5 regarding the standard of proof in criminal cases.  Is a "beyond a reasonable doubt standard" too high in a criminal prosecution?  Does it allow too many defendants to get "off"?  Why is this criminal standard so high? Discuss these questions in depth, give your opinions and respond to two other students in the week 5 discussion board.
