Introduction

The question of whether male correction officers should be employed in adult female

correctional facilities, or having female correction officers working in adult male correctional

facilities is a nuanced discussion. The conflict lies in the legal protections of the correctional

officers and the rights that protect the inmates. Title VII of the Civil Rights Act of 1964

disallows gender discrimination in employment (Ingram, 2000). While employees are protected

under Title VII, inmates have protection under the Fourth Amendment, which claims the “right

of the people to be secure in their persons . . . against unreasonable searches . . .” (Ingram, 2000).

There is no law that determines which right yields a higher jurisdiction in correctional facilities.

As such, this guarantees a conflict between the right of correctional officers to equal employment

opportunities, regardless of the gender of the inmates in the prison, and the right of the inmates

to some degree of privacy. Adding on to the conflict of the rights of prison guards and inmates

colliding, one must consider the ethical implications of the cross-gender employment of

correctional officers. The sexual assault committed by male correction officer on female inmates

is a problem that has reached epidemic proportions throughout the nation (De Amicis, 2005).
