Two assignment: 1, class discussion (250 words), 2 reply my classmates’ discussion, I will post here some and you should choose one to reply (150 words)

1, We have learned that the some of the rights in the Bill of Rights are for people that are suspected of being involved in criminal activity.

The rights contained in the Bill Rights are part of what makes the United States unique.  Now that you know the importance of the 4th, 5th, 6th, and 8th.  Consider this case:

You are a homicide detective and are investigating the abduction of a 7 year old girl.   It's Saturday night, 11PM.  Police officers have brought in a sexual registrant to the station.  He is is on parole for a sexual assault of a child and was recently released from prison.  He  matches the description of a person who was seen riding a bike near the girl's home and he lives two blocks away from the missing girl.

Although not under arrest he is technically in custody and you read him his Miranda Rights. He waives his rights and after a lenghty interrogation, he tells you that he raped the girl and has left her tied up in a vacant building without food or water and hopes she dies.  He refuses to answer any other questions when you ask him about the details and location of the girl.  He states that will not answer anymore questions. He wishes to invoke his right to remain silent and wants a lawyer.

What will you do? You truly believe that he raped her, he has told you that he raped her, and you believe him when he tells that she is still alive.

REMEMBER, he has asked for a lawyer.  It's Saturday night and doesn't want to talk anymore.  If you arrest and book him, you have present this case on Tueday and hope that the DA files charges.  However, you don't haven't located the vicitm.

Will you continue to interrogate him after invoking his right to remain silent and what is your plan to find the girl?

Here is where you use RS, PC, warrants, and your knowledge on interrogations, Miranda Rights, parole restrictions, and many other resources that you can use as an investigator.

Ok Detective what will you do?!      Her life is in your hands.  Solve this one before she dies!!!!!!

In this case, I will first try to find a lawyer for the suspect to make sure we can do more investigation in this situation and I am sure Saturday will be available to find a lawyer for him. The reason I do this find a lawyer for him because I want him to talk and talk more about the location on the girl and hope to buy more time. Next, I will find a team to find all the vacant building in the nearby location and hope we can find the victim. I think it is more possible to stay in the nearby location. After I read the topic, I understand in the Saturday night and if I choose to arrest and book him will be postpone the case until Tuesday, and it will make that victim in the danger and I always think life is the most important thing. Second, I will check all the cameras that they have in the nearby place to search where it is in he move with the victim. Third, I hope to find the way for him to waive his right again and I hope him to talk more by using the random talking method and try to makes me to talk or talk with the lawyer when the lawyer came and I think it maybe able for us to use the lawyer to talk to him. Last, I hope these method would be able to find the victim and have a great chance to save the victim by successfully search for it.

This case will definitely be one for the books as much as I would want to Waterboard this MF into telling me the whereabouts of this little girl, I feel like the the way to do it is the legal way. I would request an immediate warrant to check this guys residence and to look for some kind of clues on where he may have taken her, any address that he may have written down, check computers for any location that he may have searched. Ask neighbor if they had seen anything suspicious  in the last couple of hours even days.  Meanwhile all this is happening I will contact lawyers to take on the case so that a full confession can possibly be made by this individual and we can find the victim and hope she is still alive. I feel like this type of case is not so easy especially when the suspect has confessed to some of the crime and not on the location of the victim. On one hand you have a confession on the suspect committing the crime on the other hand you have a missing child with no knowledge on her location or her condition. Hoping that she is still alive and in one piece, having the media help out may be something that can also help solve the case. Maybe they were seen in public by someone and that can help marrow down the search of where they were last seen. Ultimately this case seems like one of those cases that never gets solved on the whereabouts of the victim. Sad to say but there has been many cases in the past that are somewhat similar and they never find the victim or years later they find the remains. So in reality this one would be hard for me to solve legally.
