Statutory Provisions
In addition to statutory provisions, what elements can affect the granting of probation?
Factors (to a greater or lesser extent) are considered in all cases relative to a granting of probation: the age and rehabilitation potential of the defendant; the defendant’s criminal record, including indications of professional criminality, organized crime, and crimes of violence; the defendant’s relationship with his or her family; any evidence of deviant behavior, such as drug abuse or sex offenses; and the attitude of the community toward the particular offense and the particular offender. Other questions may also be considered: Does the defendant’s attitude toward the offense indicate genuine remorse? Was probation promised to the defendant to induce the victim with restitution? Will being placed on probation enable the defendant to provide support and care for his or her family.
