Briefing Paper 1: Critical Legal Thinking

Instructions:

  • Assume your readers know the facts of the case and are only seeking your opinion on what standard should be held when a used-car dealer disposes of secured collateral. Should the UCC or legal precedent prevail? Do not concern yourself with the legalities of this case, instead focus on information that will help you answer the questions propounded above.



Briefing Paper 2: Law Case with Answers

Instructions:

  • Read Mitsch v. Rockenbach Chevrolet in your Cheeseman textbook on pages 260-261.
  • Assume your readers know the facts of the case and are only seeking your opinions on whether or not the use of �As Is� disclaimers should be honored by the courts. Also, are they ethical?
  • Provide convincing arguments for both sides of these issues.



Briefing Paper 3: Critical Legal Thinking Cases

Instructions:

  • Read the following sections in your textbook:
    • Sections 12.3 Implied Warranty of Merchantability (pp. 261-262),
    • 13.7 Fraudulent Transfer (p. 285),
    • 12.7 Battle of the Forms (pp. 262-263), and
    • 13.2 Buyer in the Ordinary Course of Business (p. 284).
  • Check the decisions of the highest appellate courts, if a case is cited, for each fact pattern.
  • Assume your readers know the facts of each scenario and are seeking your opinions on whether or not each of the four subjects affect business in the United States. If so, provide the worst and best case scenarios.



Briefing Paper 4: Ethics Case

Instructions:

  • Read Section 12.9 Ethics in your Cheeseman textbook on page 263.
  • Assume your readers know the facts of the case and are only seeking your opinions on the three questions found at the end of Section 12.9. Argue both sides of all issues.
